This Personal Data Protection Notice (“Notice”) is issued pursuant to the Personal Data Protection Act 2010 (“Act”) and for the purpose of this Notice, "Personal Data" shall have the meaning as ascribed to it under the Act.

 

This Notice applies to the persons governed under the Act and serves to inform you how your Personal Data is controlled, processed and/or used by Institute of Technology PETRONAS Sdn. Bhd. (“ITPSB”), a company incorporated under the Companies Act 2016 which owns and manages Universiti Teknologi PETRONAS (“UTP”) located at 32610 Bandar Seri Iskandar, Perak Darul Ridzuan. Centre for Advanced and Professional Education (“CAPE”) is a department in UTP which provides training and professional programmes. ITPSB, UTP and CAPE shall hereinafter be collectively referred to as “UTP”.

 

For the purpose of this Notice, Personal Data includes data collected and to be collected before and after issuance of this Notice.

 

1.         Collection of Personal Data

For the purpose of delivering the PENJANA Kementerian Pengajian Tinggi (KPT)-Career Advancement Programme (CAP) (“Programme”), it is necessary for you to provide UTP and for UTP to collect data about yourself that is subject to Personal Data Protection Act 2010, other applicable data protection, privacy or similar laws (collectively referred to as "Personal Data") for the purpose of usage, processing, storing and recording from time to time.

 

2.         Types and Nature of Personal Data

The Personal Data UTP collects from you includes but not limited to your name, identity card number, date of birth, age, gender, address, contact details, and employment details. We may also collect Personal Data which is of sensitive in nature such as physical or mental health or medical condition, religious beliefs or other beliefs of a similar nature. The Personal Data collected may also include copies and other forms of supporting documents. For the purpose of this Notice, Personal Data includes data collected and to be collected before and after issuance of this Notice.

 

3.         Impact Resulting from Failure to Supply Personal Data

The supply of Personal Data is necessary for UTP to deliver the Programme to you. If you do not provide your Personal Data, UTP may not be able to (i) process your registration or (ii) communicate with you.

 

4.         Processing of Personal Data

Your Personal Data is collected by UTP for the following purposes:

a. For delivering the Programme;

b. For communicating with you  and responding to queries from you in relation to the Programme;

c. For internal administrative functions;

d. For compliance of any obligations and/or regulatory requirements under any laws, rules, regulations, by-laws, national policies or court orders including by providing information to the enforcement agencies, regulatory/statutory bodies and other government agencies for any lawful purposes;

e. For data analytics; and

f. For any other purposes that are incidental or ancillary to any of the above purposes.

 

5.         Disclosure and Transfer

 a. UTP may disclose your Personal Data to KPT, our employees, our affiliates, our strategic partners, our service providers/vendors, our appointed agents, our consultants, our legal advisors, our external auditors and any person who is under a duty of confidentiality to UTP.

b. If necessary and expedient, we may also disclose your Personal Data to any other third parties including but not limited to professional bodies, training institutions, banks, financial institutions, any governmental and/or non-governmental authorities, agencies, bodies or departments.

c. UTP shall disclose your Personal Data to whom we are compelled or required to under the law.

d.  Your Personal Data may be transferred for any of the purposes mentioned under paragraph 4 to any of the above-mentioned parties who are located within or outside Malaysia.

 

6.         Retention

Any Personal Data supplied by you will be retained by UTP as long as it is necessary and expedient for the fulfilment of any purpose as stated above pursuant to our internal practices, regulatory requirements, legal and accounting requirements.

 

7.         Security and Integrity

a. UTP is committed and shall endeavour to implement the appropriate administrative and security safeguards and procedures in accordance with the applicable laws and regulations to prevent unauthorized or unlawful processing of your Personal Data and any accidental loss or destruction of, or damage to, your Personal Data.

b. To ensure that your Personal Data in our retention is accurate and up-to-date, you are advised to notify us promptly in the event of any inaccuracy or any changes to your Personal Data.

 

8.         Access and Correction

a. If you wish to request access to or to rectify your Personal Data or withdraw/limit your consent, you may send your request in writing to the following:

b. Your request shall be subject to any applicable legal restrictions, conditions and a reasonable time period.

 

 

9.         Consent

 

a. Please also note that from time to time, we may request for new Personal Data from you. By providing us with your Personal Data or continuing to communicate with UTP, we shall regard that you have consented to the processing of such data.

b. UTP shall have the right to modify, update or amend the terms of this Notice at any time. By continuing to communicate with UTP or by continuing to use UTP’s services following the modifications, updates or amendments to this Notice, it shall signify your acceptance of such modifications, updates or amendments.

Duration
All registered participants of the Programme are obliged to complete the entire course for a duration of five (5) to six (6) weeks depending on the respective course duration. Any participant who withdraws from the Programme after acceptance will be required to pay the full course charges amounting to RM5,280.00 which shall be paid by the participant to UTP.


Travelling (Physical course only)
All travelling costs will be borne by the participants.


Accommodation (Physical course only)
For courses conducted face-to-face or physically, accommodation will be provided by UTP at its campus in Bandar Seri Iskandar for the whole duration of the Programme including weekend. The cost of accommodation, which shall be for the participant only, shall be borne by UTP.

 

Food and Beverages (Physical course only)

For courses conducted face-to-face or physically, UTP shall provide F&B but only while the course is in session. Typically, this will consist of morning and afternoon tea break, and lunch. No food will be provided during weekends and Public Holiday.

 

RT-PCR COVID-19 Test (Physical course only)

Prior to entering the UTP campus to attend courses conducted face-to-face or physically, participants are required to undergo the RT-PCR Test. UTP will bear the costs for the RT-PCR test only once over the duration of the Programme, subject to a maximum amount of RM300 per pax. Kindly submit your claim together with the official receipt from the clinic to CAPE, UTP for reimbursement purposes.

 

Amendment or Cancellation of the Programme

UTP reserves the right to amend the content, timing, speaker(s) and venue as well as cancel the course due to unforeseen circumstances. Every effort will be made to inform all registered participants of any cancellation/amendment at least one (1) week before the Programme. CAPE shall not be held liable for any cost arising from this amendment/cancellation.


Other Terms and Conditions

Participants shall comply with all instructions and conditions imposed by UTP including any Standard Operating Procedure imposed by UTP Covid Response Team. Such terms and conditions shall be provided in the Joining Instruction and/or notified to the Participants from time to time.
