CONTENT SUMMARY

INTRODUCTION

Commercial arrangements sealed with signatures or handshakes are part of daily life for most professionals, across all industries and sectors. They remain good business practice because they’re built on enforceable principles of contract law. Yet with vaguely expressed contracts, unclear offers or acceptance, or even with questions of consideration or undue influence, contractual disputes are still commonplace.

This course will explore such details as when you need a contract, what type of contract exists and the effect of statutory law on your contractual arrangements. It covers the crucial ingredients required for a good contract, provides tips for understanding contractual material, and looks at the traps and pitfalls of contract drafting. The instructor will spend detailed time teaching participants how to interpret examples and scrutinize what happens when things go wrong.

Upon completion of this course, participants will be able to:

  • Recognize and analyse how good contract will protect the rights and duties the parties in the agreement.
  • Examine and address current topical issues in contract law.
  • Review a select sample of contracts clauses to identify responsibility and liability Implement drafting changes that improve contract clarity and structure.

1. Puan Nur Arfah Abdul Sabian                                               

Nur Arfah Abdul Sabian is lecturer in Department Management and Humanities, UTP. Graduated in 2007 and 2008 with Double Degree in LLB(Hons) and LLB Shariah (Hons) from  Ahmad Ibrahim Kuliyyah of Laws, International Islamic University Malaysia. She finished her Master In General Law (LLM) in 2011 at Kuliyyah of Laws, UiTM Shah Alam. Currently she is doing her PhD research on Parliamentary reform initiatives from the perspectives of Constitutional law.  She had experiences teaches Courses such as Penal Code Studies, Islamic Family Laws, Islamic Banking and Finance laws in her previous institution.  As for the current, she teaches Commercial and Cyberlaw courses, Business laws, not to mentioned the national requirement courses such Malaysian Studies and Hubungan Etnik as well.
